What We Do: Non-Litigated Debts/Pre-Litigation (Unsecured Debts)
Step One: Client intake - clients who contact our firm should thoroughly disclose all debts they have that may be in collections or are currently litigated. Clients can then determine which accounts the firm represent the client on to negotiate a settlement. Clients can then determine which accounts they would like assistance with, choosing to retain for a single debt case, or for all debts that are in collections or will soon be in collections. Client's can choose between several models of representation, from full attorney representation to simple document preparation or consultation for how to move forward.
Step Two: Upon completing a retainer agreement and remitting payment for the flat fee charged by our firm, clients will consult with Attorney McCarthy to determine the client's ability to repay - whether that is through a reduced balance lump sum settlement, or a settlement negotiated to have affordable monthly payments.
Step Three: If retained for representation on settlement negotiations, Attorney McCarthy will begin work on your case by notifying all covered creditors of her representation. Ms. McCarthy will endeavor to work with client's creditors directly to prevent litigation where possible, saving the client time and court costs and fees, and to craft an affordable settlement plan. Upon contacting your creditors, our firm will negotiate a settlement that is affordable for the client. This may or may not include a balance reduction. No offers will be accepted without express client approval. Once a settlement is reached, Attorney McCarthy will provide documentation of the settlement to the client for their records, and so that the client may remit payment according to the settlement terms.

Each situation is unique and will be assessed on a case by case basis to determine the time and costs required to reach a settlement. - Non-Litigated Personal Case - The case is not filed with a court of jurisdiction, and client has not been served with a summons. Your attorney can immediately reach out to creditors directly to begin negotiating a settlement to try to prevent the creditors from filing the case with the court of jurisdiction.
- General Cost: $400 for first debt, plus $250 for each additional debt.
- Non-Litigated Small Business Debt Case - The case is not filed with a court of jurisdiction, and client has not been served with a summons. Your attorney can immediately reach out to creditors directly to begin negotiating a settlement to try to prevent the creditors from filing the case with the court of jurisdiction.
- General Cost: $1,000 for first debt, plus $750 for each additional debt.
- Consultation for Settlement Tactics ONLY - available for anyone, without or in addition to document preparation.
- Personal Debts: $150
- Business Debts: $300
